| Description | Text analysis the nature, importance and impacts of some loopholes in the new criminal legal regulations given by the Criminal Code No 40/2009 SB, as amended by Act No 306/2009 SB and in the Justice Young Maters Act No 218/2003 SB, as amended by Act No 41/ 2009 SB (as amended by Act No 306/2009 SB). From point of effective control of criminality view, else precriminality it gives a question how fill this loopholes in the legal regulations, during its aplication. Conclusion: discovered loopholes in the new legal regulations are not possible to bridge by the extensive interpretation, because in fact is this analogie of act in malam partem, and thus forbidden. Right away is in order to the change of legal regulation. |
