Description Commentary on the provisions of Articles 20 and 21 TFEU. These two provisions regulate EU citizenship and residence rights. This chapter explores and explains the difference between EU citizenship and the concept of state citizenship; the nature of EU citizenship and the content of the rights and obligations associated with EU citizenship. Primary beneficiaries, secondary beneficiaries - family members, as well as other members and partners are defined. The so-called EU element is discussed in depth, as well as the various legal residence regimes and their duration, the associated residence rights of static EU citizens, and the social benefits of migrant citizens. Attention is also paid to the permitted restrictions on movement and residence and the conditions under which the EU can legislate in this area. The relationship to other provisions of the TFEU which also regulate this issue is also analysed.
