Description The article aims to introduce the Czech legal regulation and case law governing the process of recognition and enforcement of foreign arbitral awards to which the United Nations Convention on the Recognition and Enforcement of Foreign Arbitral Awards applies. To begin with, the recent case law which impedes the enforcement of foreign arbitral awards to which the United Nations Convention on the Recognition and Enforcement of Foreign Arbitral Awards applies in execution proceedings due to the absence of the recognition proceedings shall be introduced. The article shall analyze the possibility of conducting such recognition proceedings according to amended legal regulation. Next, the regulation of declaration of enforceability of foreign arbitral awards to which the United Nations Convention on the Recognition and Enforcement of Foreign Arbitral Awards applies shall be introduced. Moreover, the current legal regulation applicable to recognition and enforcement of domestic arbitral awards as well as enforceable foreign court decisions under European law shall be analyzed. The article shall evaluate the compliance of current legal regulation and case law with Article III of the United Nations Convention on the Recognition and Enforcement of Foreign Arbitral Awards according to which substantially more onerous conditions shall not be imposed on the recognition or enforcement of foreign arbitral awards than are imposed on the recognition or enforcement of domestic arbitral awards.
