Description The preconditions for issuing a default judgment are set out in Section 153b of the Code of Civil Procedure. That provision sets out, inter alia, the conditions defyning the plaintiff's activity (application for a default judgment) and the defendant's inactivity (absence from the first hearing). According to the commentary literature, there is room for a default judgment even if the defendant commented in writing before the hearing in the case, proposed the action to be dismissed and submitted to the court the documentary evidence he relied on. On the other hand, such procedural activity of the defendant is considered by the Constitutional Court to be an obstacle to the issuance of a default judgment (eg IV. ÚS 3143/15, IV. ÚS 2785/2007, Pl. ÚS 49/2010). However, this and other selected preconditions for issuing a default judgment can be compared with the opinions of foreign legal science and practice and legislation (here Austrian), which also knows this type of judgment, and based on the knowledge gained to draw a possible solution for Czech legislation.
