Description This paper aims to present a general interpretation of the principle of the precedence of Community law and its relation to fundamental rights and freedoms as they are defined in EC/EU legislation at present, and to consider possible changes after the entry into force of the Lisbon (reform) treaty. It will examine the validity or otherwise of the proposition that the entry into force of the Charter of fundamental rights will limit the sovereignty of the Member states and could result in some of their older legislation being revised directly by EC/EU institutions.
