Description While making a qualification of administrative aktivity for the purpose of administrative justice, certain border situations, when it is unclear which type of administrative action should be used, may occur. The practice of administrative courts as yet is not unified and is not wholly conceptual. The selection of wrong type of action nevertheless can have a significant impact on the petitioners. The goal of the paper is to explain the issue of the (unclear) border situations, mainly with the example of consents issued under the Building Act, and to outline approaches to the solution of problems steming from these situations.
