Description | The purpose of this article is to evaluate the new legal forms of collective investment that is governed by the Act on Investment Companies and Funds in relation to Civil Code. The new legislative regulation strengthened the variability of investment forms, which is expected to remove many obstacles that have, in terms of European market, so far lowered the attractiveness of the Czech Republic to the management companies. It will focus on legal forms that are of crucial importance for convergence to the European standard: Trust Fund, a joint-stock company with variable registered capital (SIAV) and a limited partnership of investment funds. The listed legal forms will be analysed from the viewpoint of their potential benefits and risks that may be expected with increasing the attractiveness of the Czech market of collective investments and the growth of resources managed by funds based in the Czech Republic. |
